Recent news that patents without declarations of assignment are to be imposed on fieldbus protocols that are standardised within IEC and Cenelec has surprised Profibus International.

Recent news that patents without declarations of assignment are to be imposed on fieldbus protocols that are standardised within IEC and Cenelec has surprised Profibus International Standards affected by manufacturers' patents must normally be listed fully in the Standard and made available to everyone on fair and equal conditions

A check carried out among Profibus International members confirms that all claims have been assigned to the standards organisations on the required conditions.

Profibus International is now checking to see whether there are any patents held by non-members that may affect Profibus.

The assignment procedure is necessary to allow a Standard to be published in the first place by the standardisation organisations.

Profibus International will take up this topic, and in the interests of its members will continue to advocate open, freely accessible standards, and support national and international standardization for proper publication.
