Nearly 60 per cent of employers believe their workforce will be affected by the effects of vibration, but most are unprepared for the Control of Vibration at Work regulations, according to experts.

Nearly 60 per cent of employers believe their workforce will be affected by the effects of vibration, but most are unprepared for the introduction of Control of Vibration at Work regulations that will be introduced on July 6 2005, according to UK and Ireland Insurance Services.

Failure to comply with the new regulations will have serious consequences.

Companies could be faced with a Notice to Comply that is enforceable within 21 days or prohibition or prosecution.

Fines of £20,000 and two year jail terms give the regulations real teeth.

"This is a very serious issue," says Martin Nugent from commercial insurance brokers, UK and Ireland Insurance Services.

"The construction and manufacturing sectors are obviously at greatest risk but a huge number of businesses expose their employees to some degree of vibration, some of the time.

"Any kind of machine with rotating parts is capable of producing damaging vibration".

The average claim for a 'white finger' vibration injury is £7100, excluding legal costs.

Nugent warns that while Employers Liability insurance will almost certainly protect bosses from such 'new' injury claims, they may need additional cover to protect them from possible prosecution under the new regulations.

"This could mean an increase in Employers Liability premiums," says Nugent.

"I'm sure all responsible employers will be taking reasonable steps to protect their employees from this cause of injury but from July they should check that they are insured against both injury claims and the other financial consequences of inadvertently breaching these new regulations".
